Welcome to the CD Mate Affiliate program, which we have created for owners of sites with big hits who think their customers might be interested in our software.

We noticed that there are few affiliate programs out there for people with MP3 and music sites, and they usually have a poor payout, so it is our intention to make the best affiliate programs for music, games and computer hardware related sites on the web.

Terms & Conditions

CD Mate Affiliates Terms & Conditions -------------------------------------- This agreement contains the complete terms and conditions that apply to an individual's or entity's participation in the CD-Mate.com affiliate program hereinafter referred to as (the "Program"). In this agreement we will use words which have the following meanings, "we" and "us" means the site and trading style CD-Mate.com of Fubra Limited, UK, and "you" means the applicant. "Site" means a world wide web site or other medium displaying information about us and, depending on the context, refers either to the CD-Mate.com site, located at the URL www.cd-mate.com, or to any site that you will link to our site. Signing up to the Program -------------------------------------- To sign-up, you need to submit a complete application using the site located at www.cd-mate.com/affiliate.php. We will evaluate your application in good faith and will notify you of your acceptance or rejection. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the Program. Unsuitable sites may include those that: promote sexually explicit materials promote violence promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age promote illegal activities violate intellectual property rights If we reject your application, you are welcome to reapply to the Program at any time. You should also note that if we accept your application and your site is thereafter determined (in our sole discretion) to be unsuitable for our program, we may terminate this agreement. Links on your site -------------------------------------- Once you have been notified that your site has been accepted into our program, you may provide on your site a link to our site which includes a code to identify your site. You must ensure that each of the links between your site and our site properly utilises the format we supply you with. You will only earn a commission on visitors who arrive at our site from links on your site in the format we will provide to you and we will not be liable to you with respect to any failure by you to use the correct link format, including to the extent that such failure may result in any reduction of amounts that would otherwise be paid to you pursuant to this agreement. You acknowledge that, by participating in the affiliate program and placing any of the above links within your site, CD-Mate.com may receive information from or about visitors to your site or communications between your site and those visitors. Your participation in the CD-Mate.com program constitutes your specific and unconditional consent to and authorisation for CD-Mate.com's access to, receipt, storage, use, and disclosure of any and all such information, consistent with the policies and procedures set forth in CD-Mate.com's privacy notice. Order Processing -------------------------------------- We will process product orders placed by customers who follow properly formatted links from your site to our site. We reserve the right to reject orders that do not comply with any requirements that we may establish periodically. We will be responsible for all aspects of order processing and fulfilment. We will make available to you reports summarising this sales activity. The form, content, and frequency of the reports may vary from time to time in our discretion. Commission Fee Schedule -------------------------------------- You will earn commission on every sale generated by visitors who were referred to our site from one of your special links before they make a sale. We will track these visitors using Cookie technology and as such you understand that if your visitors do not have Cookie technology turned on then we will be unable to track the order and you will not receive a commission on such a sale. The current commission schedule is: 10% of the value of CD Mate and this may change from time to time this excludes VAT. Commission Payment -------------------------------------- We will pay you commission due to you on demand which you can make once logged in to our site. You must request payment via our secure affiliate area or it will not be made no other type of requests will be valid. We make use of Paypal to pay you and your credit will be made into a paypal account which you will supply us with details of if you do not have a paypal account you will need to sign up for one before we will make any payment. No other forms of payment will be given. If the commission payable to you for is less than 50 GBP, we will not make a payment until the total amount due is at least 50 GBP. If the agreement is terminated before your account reaches 50 GBP you forfeit all commission earned. If any customer who purchases CD Mate on our site and who we pay you commission for makes a chargeback to our account which we are not able to recover or if the purchase is fraudulent we will deduct the commission from such sales and you will not earn a fee. Linking to us -------------------------------------- When you link to CD-Mate.com you may link to the site in any way you see fit as long as you keep to the following guides. Any links which we feel are not in the spirit of these guides we may terminate this agreement with that affiliate. In general we want the guides below such that visitors to our site are interested in the content it is not in your interest or ours for them to be fooled into visiting CD-Mate.com and that is what we will use to judge your links. you must not trick your visitors to entering our site. our site must not appear as a popup or via other unsolicited means to your visitors. you should display clearly the content of the link such that the user knows they will be entering a site about CD copying software. you may use either text or image links of your own or ones recommended by us. you should not write any details about CD-Mate.com or CD Mate which you cannot prove to be true. Your Site -------------------------------------- In linking to our site we take no responsibility whatsoever for the content of your site and you agree to indemnify and hold us harmless from all claims, damages, and expenses relating to the development, operation, maintenance, and contents of your site Term of the Agreement -------------------------------------- The term of this Agreement will begin upon our acceptance of your Program application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination via email. Modification -------------------------------------- We may modify any of the terms and conditions contained in this agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on our site. If any modification is unacceptable to you, your only recourse is to terminate this agreement and your continued participation in the program following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change. Disclaimers -------------------------------------- We make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. Law -------------------------------------- You agree that any legal disputes, which arise out of the implementation of this agreement, shall be handled under the laws of England & Wales. By using our service you agree to this agreement being consented to under the jurisdiction of the English & Welsh courts.
